Terms of Service

These Terms of Service govern your use of MyNextWebsite subscription-based managed platforms, portals, products, design features, and related technical services. By subscribing to or using our sites or services, you agree to these terms.

Service scope

MyNextWebsite provides managed website design, development, domain configuration, serverless edge hosting infrastructure, security setups, and ongoing maintenance services. Specific subscription tier deliverables, edit turnaround times, and hosting bandwidth policies are governed by your subscription purchase details.

Important notice: General platform features, template layouts, reports, and recommendations are informational. We design with industry security standards and anti-abuse checks, but do not guarantee 100% protection against zero-day exploits, target server outages, or third-party API deprecations.

Authorized use

You may only submit domains, brand assets, code segments, business details, or media files that you own or are fully authorized to use on your website. Attempts to bypass platform security, inject malicious payloads, spam or scrape visitor pages, run unauthorized load tests, or disrupt serverless API performance may result in immediate suspension or termination of your subscription.

Payments and subscriptions

Our managed service is billed as a monthly recurring subscription. Billing details, credit card authorizations, and payment schedules are handled securely via our payment gateways. Subscriptions are billed in advance, and you can request cancellation at any time. Active sites are maintained and hosted through the end of the paid billing cycle, after which hosting is suspended and assets are archived.

Intellectual property and asset ownership

Ownership of website materials and design elements is structured as follows:

  • Customer Assets & Content: You retain 100% full ownership of all text, logos, customer-provided images, media, and proprietary business data submitted to or published on your website.
  • Custom Websites: On Custom Website builds, you own the custom website design and front-end implementation created specifically for your business. For any custom illustrations, graphics, and visual assets created by MyNextWebsite, MyNextWebsite retains copyright while granting you a perpetual, exclusive license to use them on your website.
  • Foundation Websites: On Foundation Website builds, MyNextWebsite retains copyright over the underlying industry foundation design, layout framework, and stock visual assets (excluding your provided content). You are granted a perpetual, non-exclusive license to use the design on your website.
  • Build Engine & Internal Tools: MyNextWebsite retains ownership of its reusable frameworks, templates, automation systems, deployment tooling, internal build processes, and supporting infrastructure. These internal tools are not transferred as part of any website project.

Account cancellation and site exit delivery

Our service is built around complete portability with no vendor lock-in. Upon written request prior to subscription cancellation, we will package and deliver your website's compiled, self-contained static HTML, CSS, JavaScript, and asset bundle. This exit delivery package allows you to host your static website independently on any web host of your choice. Source files, build tooling, automation workflows, and reusable framework components are not included in the exit package.

Content edits and updates

Subscription tiers include reasonable minor text, link, and image modifications on existing pages (up to 3 separate update requests per billing cycle, typically completed within 2 business days). Custom layout overhauls, structural changes, database migrations, new page additions, or advanced serverless integrations outside the site's initial scope are evaluated individually and require a separate custom quote or service agreement.

Third-party services

Our service relies on third-party service providers for CDN edge nodes, Cloudflare Turnstile anti-spam features, Zoho ZeptoMail transactional notifications, serverless hosting runtimes, and payment gateway routing. We are not responsible for global outages affecting these vendors. Any licensing, subscription, or usage fees associated with third-party tools integrated into your website (including but not limited to scheduling tools, CRM platforms, email marketing software, or custom widgets) are the sole responsibility of the client.

Limitation of liability

To the maximum extent permitted by law, MyNextWebsite (and its parent Axionix Systems LLC) is not liable for indirect, incidental, special, consequential, or exemplary damages, or for losses arising from missed leads, security incidents, downtime, serverless cold starts, form submission failures, or third-party service failures.

Governing law

These terms are governed by the laws of Texas, United States, without regard to conflict-of-law principles.
